Terms of service

TERMS OF SERVICE

Last updated: 25 August 2026

OVERVIEW

Welcome to Enè. The terms “we”, “us” and “our” refer to Enè.

Enè operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).

Enè is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in them, describe your rights and responsibilities when you access or use our Services or purchase products from us.

Please read these Terms carefully before using our website or placing an order.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms limits or excludes any mandatory consumer rights available to you under applicable law.

SECTION 1 — ACCESS AND ACCOUNT

By using the Services, you represent that you have the legal capacity to enter into a binding agreement under the laws applicable to you.

If you permit a minor to access or use the Services, you are responsible for their use of the Services to the extent permitted by applicable law.

To use certain parts of the Services or purchase products from us, you may be asked to provide information including your email address, billing information, payment information and shipping information.

You represent that the information you provide is accurate, current and complete and that you have the right to provide this information.

You are responsible for maintaining the security of your account credentials and for activity carried out through your account.

You may not transfer, sell, assign or license your account to another person without our permission.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to display and describe our products as accurately as possible.

However, colours and product appearance may vary slightly depending on your device, screen settings, lighting and other factors outside our control.

Due to the nature of jewellery and production processes, minor variations between individual pieces may also occur where these variations do not materially change the product.

These reasonable variations do not affect your rights if a product is faulty, materially different from its description or otherwise does not conform to your purchase contract.

Product descriptions, availability and collections may be updated from time to time.

We reserve the right to discontinue products or limit the quantities available for purchase where reasonably necessary.

SECTION 3 — ORDERS, RETURNS AND WITHDRAWAL

Placing an Order

When you place an order through Enè, you are making an offer to purchase the selected products.

Your order is not accepted until we confirm acceptance of the order.

Payment must be successfully authorised and processed before an order can be completed.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, product unavailability, incorrect customer information, obvious pricing errors or other legitimate reasons.

If an order for which you have already paid is cancelled by us, we will refund the relevant amount using your original payment method.

Please check your order carefully before submitting it. Once an order has entered processing or has been dispatched, we may not be able to accommodate cancellation or modification requests.

If we need to contact you regarding an order, we may use the email address, telephone number, billing address or other contact information you supplied when placing the order.

Products purchased from Enè are intended for personal or household use unless otherwise agreed with us.

15-Day Return and Withdrawal Period

For eligible purchases made online, Enè gives you 15 calendar days from the date you receive your order to notify us that you wish to return an item or withdraw from the purchase without giving a reason.

This 15-day period is provided by Enè in addition to and does not restrict any mandatory withdrawal rights available to consumers under applicable law.

Where an order contains multiple products delivered separately, the withdrawal period begins when you receive the final product from that order where required by applicable law.

To exercise your right to return or withdraw, you must clearly notify us within the applicable period.

You may do this:

  • through the electronic withdrawal function provided on our website; or

  • by contacting us at info@enejewellery.com and clearly stating that you wish to return your purchase or withdraw from the contract.

Please include your order number and the product or products you wish to return so that we can process your request.

After notifying us of your return or withdrawal, you must send the products back without unnecessary delay and no later than 14 calendar days after notifying us, unless a longer period is required by applicable law.

Return Shipping Costs

For ordinary change-of-mind returns, the customer is responsible for the direct cost of returning the products to Enè, including return postage.

We strongly recommend using a tracked return service and keeping proof of postage until your refund has been completed.

If a product is faulty, damaged, incorrect or otherwise does not conform to the purchase contract, return shipping costs will be handled in accordance with your statutory consumer rights. Where applicable, Enè will bear the reasonable return costs for defective or non-conforming products.

Refunds

When you validly withdraw from an eligible purchase, we will refund:

  • the price paid for the returned product; and

  • the cost of the original standard delivery option applicable to the order.

If you selected a delivery method that was more expensive than our least expensive standard delivery option, such as express, priority or expedited shipping, the additional cost of that upgraded delivery service will not be refunded.

Refunds will normally be made using the same payment method used for the original purchase unless otherwise agreed.

We will process the refund without undue delay and within the period required by applicable law.

We may withhold the refund until we have received the returned product or until you provide satisfactory evidence that you have sent the product back, whichever occurs first, where permitted by applicable law.

Condition of Returned Products

You may inspect a product to the extent reasonably necessary to establish its nature, characteristics and appearance, similar to how you would normally be able to inspect an item in a physical shop.

You are responsible for taking reasonable care of products while they are in your possession.

Where permitted by applicable law, we may reduce the refund to reflect a reduction in value caused by handling or use beyond what was reasonably necessary to inspect the product.

Products returned under our change-of-mind return policy should be returned with their original components and packaging where reasonably possible.

Earrings and Hygiene

For hygiene reasons, earrings that have been worn, tried on, inserted into a piercing or otherwise used cannot be returned for a change of mind.

Where earrings are supplied in sealed hygiene packaging, removing or breaking the hygiene seal may also result in the loss of the right to return the product where permitted by applicable law.

Please inspect earrings visually before wearing or inserting them.

This hygiene restriction does not affect your statutory rights if the earrings are faulty, damaged, incorrectly supplied or otherwise do not conform to the purchase contract.

Personalised Products and Other Exceptions

The right to withdraw may not apply to products that are made to your specifications, clearly personalised or otherwise fall within a legal exception to the right of withdrawal.

Any applicable restriction will be communicated to you before purchase where required.

Faulty or Non-Conforming Products

The 15-day change-of-mind return period is separate from your rights regarding faulty or non-conforming products.

If an item is faulty, damaged, does not match its description or otherwise fails to conform to the purchase contract, please contact us at info@enejewellery.com.

Your statutory legal guarantee and consumer rights continue to apply regardless of whether the 15-day change-of-mind return period has expired.

SECTION 4 — PRICES AND BILLING

Prices displayed in our online store include all taxes that Enè is required to charge and collect, where applicable, unless otherwise clearly stated.

Shipping charges and any other charges that can be calculated in advance will be displayed before you complete your order.

Customs, Import Duties and Taxes

Orders shipped internationally or to destinations outside the applicable customs territory may be subject to customs duties, import VAT, import taxes, customs handling fees, brokerage charges or other fees imposed by the destination country or relevant authorities.

These charges may be collected when the shipment enters your country or before the carrier releases the parcel to you.

Unless we expressly state at checkout that these charges have been collected by Enè, customs duties, import taxes and similar destination charges are not included in the product price or shipping price and are the responsibility of the customer.

Enè does not control customs authorities and cannot always predict whether charges will apply or the amount that may be charged.

Customers are responsible for checking any applicable import requirements or charges in their destination country before ordering.

Prices, discounts and promotions may change without notice. The price charged for a product will be the price displayed when the order is placed and confirmed in your order confirmation.

Promotions may be subject to additional promotional terms. If specific promotional terms conflict with these Terms in relation to that promotion, the specific promotional terms will apply.

You agree to provide accurate and complete payment and billing information.

You represent that you are authorised to use the payment method provided and that charges made using that payment method are authorised by you.

SECTION 5 — SHIPPING AND DELIVERY

We will deliver your order to the delivery address provided during checkout using the shipping method selected or otherwise agreed with you.

Delivery times shown on our website are estimates unless we have expressly agreed to a specific guaranteed delivery date.

We will make reasonable efforts to dispatch and deliver orders within the estimated timeframe.

Delays may occasionally occur because of customs processing, carrier disruptions, weather, transport interruptions, public holidays or other events outside our reasonable control.

Where such circumstances occur, we will not be responsible for the delay itself to the extent permitted by applicable law. However, this does not remove or restrict any statutory rights you may have regarding late or failed delivery.

Risk of loss or damage to the products remains with Enè until you, or a third party designated by you other than the carrier, takes physical possession of the products.

If you independently arrange for a carrier that was not offered by Enè, risk may pass to you when the products are handed to that carrier, to the extent permitted by applicable law.

If your parcel does not arrive, please contact us so that we can investigate the shipment and provide any remedy required under applicable law.

SECTION 6 — INTELLECTUAL PROPERTY

Our Services, including but not limited to our trademarks, brand identity, logos, product names, text, photographs, images, graphics, illustrations, video, audio, website design, layouts and other content, are owned by or licensed to Enè and are protected by applicable Lithuanian, European Union and international intellectual property laws.

These Terms permit you to use the Services for your personal and non-commercial use.

Unless expressly permitted by us or applicable law, you may not reproduce, distribute, modify, publish, publicly display, republish, download, commercially exploit or create derivative works from our content without prior written permission from Enè.

Nothing in these Terms grants you ownership of or a licence to any intellectual property belonging to Enè, Shopify or any third party except where expressly stated.

The Enè name, logos, product names, designs, graphics and slogans belonging to Enè may not be used without our prior written permission.

Shopify's names, trademarks, logos and related intellectual property belong to Shopify or its licensors.

All other trademarks and intellectual property displayed through the Services remain the property of their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools or services supplied by third parties.

We do not necessarily control or monitor these third-party tools.

Your use of third-party tools may also be governed by the relevant third party's terms and privacy policies.

To the extent permitted by applicable law, Enè is not responsible for problems arising solely from third-party tools that are outside our control.

You should review the relevant third-party terms before using optional tools.

Nothing in this section limits any mandatory rights or remedies available to you under applicable law.

We may add, modify or remove features or tools made available through the Services from time to time.

SECTION 8 — THIRD-PARTY LINKS

Our Services may contain links to websites, services or content operated by third parties.

These third-party websites are not controlled by Enè, and we are not responsible for their content, availability, privacy practices or terms.

If you choose to access or purchase something through a third-party website, your relationship with that third party will normally be governed by its own terms and policies.

To the extent permitted by applicable law, Enè is not responsible for loss or damage caused solely by your dealings with an independent third party outside our control.

Complaints or questions concerning third-party products or services should normally be directed to the relevant third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Enè is powered by Shopify, which enables us to provide the Services to you.

However, products purchased through our store are sold directly by Enè.

Your purchase contract is therefore with Enè unless expressly stated otherwise.

Shopify provides technology and infrastructure used to operate the store but is not the seller of Enè products.

Nothing in this section limits any rights you may have directly against Enè as the seller.

SECTION 10 — PRIVACY POLICY

Personal information collected through our Services is handled in accordance with our Privacy Policy, which can be viewed here: [PRIVACY POLICY LINK].

Because our store is hosted by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services in order to provide its services to Enè.

Shopify's applicable privacy information can be viewed here: https://www.shopify.com/legal/privacy/app-users

Information may also be processed by service providers involved in operating our store, processing payments, fulfilling orders, delivering products, preventing fraud, providing customer support or performing other necessary services.

Please review our Privacy Policy for more detailed information about how personal information is collected, used, stored and shared and about the rights available to you.

SECTION 11 — FEEDBACK, REVIEWS AND USER CONTENT

If you voluntarily submit a review, photograph, suggestion, feedback, comment, idea or other content to Enè (“Feedback”), you confirm that you have the necessary rights to submit that content.

Unless otherwise agreed, you grant Enè a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, publish and adapt that Feedback for purposes connected with operating, improving and promoting Enè and its Services, to the extent permitted by applicable law.

If you received compensation, free products or another incentive in connection with Feedback or a review, you must disclose this where required by law.

You may not submit Feedback that:

  • infringes another person's intellectual property or privacy rights;

  • contains unlawful, defamatory, threatening or abusive material;

  • contains malicious software or code;

  • is deliberately false or misleading; or

  • falsely represents your identity or relationship with another person or organisation.

We may remove content where we reasonably believe that it violates these Terms or applicable law.

Nothing in this section permits Enè to use your personal information contrary to our Privacy Policy or applicable data-protection law.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

We make reasonable efforts to ensure information on the Services is accurate.

However, occasional typographical errors, inaccuracies or omissions may occur in relation to product descriptions, prices, promotions, availability, shipping costs or delivery estimates.

We may correct genuine errors and update information where necessary.

If an obvious pricing, availability or product-information error affects an order, we may contact you to correct the issue or, where legally permitted, cancel the affected order and provide a full refund.

Nothing in this section removes any rights you have where information provided before purchase was incorrect, incomplete or misleading in a manner that gives rise to rights under applicable law.

SECTION 13 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services, directly or indirectly:

  • for unlawful, fraudulent or malicious purposes;

  • to violate applicable international, European Union, national or local laws or regulations;

  • to infringe the intellectual property or other legal rights of Enè or another person;

  • to harass, threaten, abuse, defame or unlawfully discriminate against another person;

  • to knowingly submit false or misleading information;

  • to distribute spam, malicious communications or unauthorised advertising;

  • to impersonate another person or organisation;

  • to interfere with the security, functionality or operation of the Services;

  • to introduce viruses, malware or other harmful code;

  • to collect or track personal information about others unlawfully;

  • to bypass access controls, security measures or technological restrictions; or

  • to reproduce, copy, resell or commercially exploit the Services without our permission.

Artificial Intelligence and Automated Services

You may not use any artificial intelligence system, generative AI service, autonomous or semi-autonomous AI agent, bot, scraper, crawler, automated data-extraction tool or similar automated technology to access, interact with, copy, collect, reproduce, analyse, extract or otherwise use any part of the Services or their content without Enè's prior written permission.

This includes, without limitation, using Enè's:

  • photographs;

  • jewellery designs;

  • product descriptions;

  • written content;

  • graphics;

  • branding;

  • customer reviews;

  • website content; or

  • other data

for artificial-intelligence training, machine-learning training, model development, dataset creation, automated content generation or other AI-related purposes.

We also prohibit AI agents from autonomously making purchases, submitting forms or otherwise interacting with the Services on behalf of another person without our prior written permission.

Standard search-engine indexing is permitted only to the extent that Enè allows such indexing through our website's technical settings.

We reserve the right to restrict or block automated access to the Services.

We may suspend or terminate access where we reasonably determine that these Terms have been materially violated.

SECTION 14 — TERMINATION

You may stop using the Services at any time.

We may restrict, suspend or terminate access to the Services where reasonably necessary, including where:

  • you materially breach these Terms;

  • your activity appears fraudulent or unlawful;

  • your activity creates a security risk;

  • you misuse the Services;

  • we are required to do so by law; or

  • continued provision of the Services is no longer reasonably possible.

Where required by applicable law, we will provide appropriate notice.

Termination does not affect rights, obligations or amounts that arose before termination.

Provisions that by their nature should continue after termination — including intellectual property, liability, governing law and other relevant provisions — will remain effective.

SECTION 15 — DISCLAIMER OF WARRANTIES AND LEGAL GUARANTEE

We aim to keep our website and digital Services accurate, secure and available.

However, to the extent permitted by applicable law, we do not guarantee that access to the website will always be uninterrupted, error-free, secure or available at all times.

The website and digital Services are provided on an “as is” and “as available” basis to the extent permitted by law.

This disclaimer does not apply to or restrict your statutory rights relating to products purchased from Enè.

Products sold by Enè are subject to all mandatory legal guarantees and conformity rights provided under applicable consumer protection law.

If you are a consumer in the European Union, you benefit from the applicable legal guarantee of conformity, including a minimum two-year legal guarantee for goods under EU consumer law.

If a product is faulty, damaged, does not match its description or otherwise fails to conform to the purchase contract, you may be entitled to remedies provided by applicable law. Depending on the circumstances, these may include repair, replacement, a proportionate reduction in price or termination of the contract and refund.

Any repair or replacement to which you are legally entitled will be provided without charge where required by applicable law.

Unless Enè expressly provides an additional commercial warranty for a particular product, we do not provide a separate commercial warranty in addition to the statutory guarantees and rights provided by law.

Nothing in these Terms excludes, restricts or limits any warranty, guarantee, remedy or consumer right that cannot legally be excluded or limited.

SECTION 16 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits Enè's liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts liability for:

  • death or personal injury caused by negligence where such liability cannot legally be excluded;

  • fraud or fraudulent misrepresentation;

  • intentional unlawful conduct;

  • liability for faulty or non-conforming products where imposed by law;

  • statutory refunds or legal guarantees;

  • rights arising under mandatory consumer protection law; or

  • any other liability that cannot legally be excluded or restricted.

Enè is responsible for loss or damage that is a reasonably foreseeable consequence of our failure to comply with these Terms, applicable law or our obligation to exercise reasonable care.

To the extent permitted by applicable law, Enè is not responsible for loss or damage caused solely by:

  • your misuse of our products or Services;

  • your failure to follow reasonable product-care or safety instructions;

  • incorrect information supplied by you;

  • unauthorised modifications made by you or another person;

  • independent third parties outside our reasonable control; or

  • events outside our reasonable control where the law does not place responsibility for the loss on Enè.

If you purchase products as a consumer for personal and non-commercial use, Enè will not be responsible for purely commercial or business losses such as loss of business profits, business opportunity or commercial revenue that were not reasonably connected with the consumer purchase.

Nothing in this section limits our legal responsibilities concerning delivery, refunds, faulty products, product conformity, legal guarantees or other mandatory consumer protections.

SECTION 17 — RESPONSIBILITY FOR MISUSE

You are responsible for using the Services lawfully and complying with these Terms.

If you intentionally or unlawfully misuse the Services, intentionally infringe Enè's intellectual property rights, compromise the security of the Services or materially breach these Terms, you may be responsible for direct losses reasonably suffered by Enè as a result of that conduct, to the extent permitted by applicable law.

You will not be responsible for losses that were not caused by your conduct or for liability that cannot lawfully be imposed on you.

Nothing in this section creates liability beyond what is permitted under applicable law or limits your statutory rights as a consumer.

SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary so that it can remain enforceable where possible.

If this is not possible, the affected provision will be treated as severed from these Terms.

The remaining provisions will continue to apply.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

If we do not immediately enforce a right or provision under these Terms, this does not mean that we waive that right or provision.

These Terms, together with the policies and terms expressly incorporated into them, form the agreement governing your use of the Services and purchases from Enè.

Nothing in this section excludes representations, information, obligations or consumer protections that applicable law requires to form part of your contract with us.

Nothing in these Terms may be interpreted as waiving mandatory consumer rights.

SECTION 20 — ASSIGNMENT

You may not transfer your contractual rights or obligations under these Terms to another person without our prior written consent, except where applicable law gives you the right to do so.

Enè may transfer its rights or obligations where legally permitted, provided that such a transfer does not reduce any mandatory consumer rights available to you.

Where notice or consent is required by law, we will comply with those requirements.

SECTION 21 — GOVERNING LAW AND DISPUTES

These Terms and any purchase contract between you and Enè are governed by the laws of the Republic of Lithuania.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protections available to you under laws that would otherwise apply to you.

Any dispute arising from these Terms, the Services or a purchase from Enè will be dealt with by the competent courts determined in accordance with applicable law.

Nothing in these Terms restricts a consumer's legal right to bring proceedings before a competent court or use an available alternative dispute-resolution procedure.

Consumer Complaints

If you have a complaint regarding a product, order or our Services, please contact us first in writing at:

info@enejewellery.com

Please include your order number where relevant and clearly explain the issue and the solution you are requesting.

We will review consumer complaints free of charge and provide a reasoned written response within the timeframe required by applicable Lithuanian law, which is generally no later than 14 calendar days after receiving the consumer's written complaint.

If we are unable to resolve your complaint, or you are not satisfied with our response, eligible consumers may have the right to seek alternative out-of-court dispute resolution through the relevant consumer-protection authority.

For Lithuanian consumer disputes, this may include the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba — VVTAT).

SECTION 22 — HEADINGS

The headings in these Terms are included for convenience and readability only.

They do not limit or otherwise affect the meaning or interpretation of the provisions.

SECTION 23 — CHANGES TO THESE TERMS

You can review the current version of these Terms at any time on this page.

We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.

Where required by applicable law, we will notify you of material changes before they take effect.

Changes to these Terms will not retroactively remove rights that you already have under an existing purchase contract unless permitted by applicable law.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by applicable law.
